A criminal-side practice: from bail in the Sessions Court to quashing petitions and appeals in the High Courts and the Supreme Court.

Most of the work is criminal litigation at the District & Sessions Court, Ghaziabad: regular and anticipatory bail under the BNSS, petitions to quash FIRs (Section 528 BNSS), defence at trial, and criminal appeals. This includes representation in offences against women, and in cruelty and dowry cases (Sections 85–86 BNS) arising out of broken marriages. Matters are also taken up in the district courts of Noida and Delhi. Divorce, maintenance, custody, domestic violence and property disputes are handled too, for clients from Indirapuram, Vaishali, Vasundhara, Kaushambi, Noida and Delhi.

Adv. Varun Chaudhary leads Nyay Law Firm with Advocate Parul Chaudhary. Clients who would prefer to consult a woman advocate can meet her at the Indirapuram office.

Where can I meet him?

At the chamber in the District Civil Court, Rajnagar, during court hours; at the Indirapuram office in the evening; or by video or phone call.

What is anticipatory bail?

It is a direction, obtained before arrest from the Sessions Court or the High Court under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), that a person be released on bail if arrested. The court looks at the nature of the accusation, the person's record and the risk of absconding, and may impose conditions.

What is the difference between regular and anticipatory bail?

Regular bail is sought after arrest. In bailable offences it is a right (Section 478 BNSS); in non-bailable offences it may be granted by the Magistrate (Section 480) or by the Sessions Court or High Court (Section 483). Anticipatory bail is sought before arrest, from the Sessions Court or High Court under Section 482 BNSS.

Can an FIR be quashed?

The High Court can quash an FIR or criminal proceedings under Section 528 BNSS, for example where the allegations disclose no offence, are vague and general (as is sometimes seen in cruelty and dowry complaints under Sections 85–86 BNS against distant relatives), the proceedings are an abuse of process, or, in suitable cases, the parties have settled. Each case depends on its own facts.

Which courts does he appear in?

His main practice is at the District & Sessions Court, Ghaziabad, where he has practised since 2010. He also appears in the district courts of Noida (Gautam Buddh Nagar) and Delhi, before the High Courts of Allahabad and Delhi, and in the Supreme Court of India. Through Nyay Law Firm, clients are also assisted in other states when a matter requires it.

Can I speak in Hindi?

Yes. Consultations, drafting and correspondence are in Hindi or English, as you prefer.

Is what I share kept confidential?

Yes. Communications with an advocate are confidential and are shared only with your consent or as the law requires.
